Prices for all products and on the Website are shown in U.S. dollars.

Billing

MySignShine, LLC accepts each of the following credit card types: Visa, MasterCard, American Express, and Discover. All credit card information is encrypted, stored, and processed through a third-party provider. For Product purchases, we generally do not charge your credit card until after your order has been shipped.

Duties and Taxes

For Canadian customers, all Duties and Taxes are the responsibility of the purchaser.  These additional fees are not included in the price of the product or the shipping fees.  MySignShine, LLC strongly recommends that Canadian customers fully understand these additional costs before making a purchase at the website.

Production and Shipping

MySignShine, LLC will always act to make sure that any production difficulties do not delay delivery schedules. MySignShine, LLC shipment and delivery dates are calculated based upon estimates provided by our suppliers. MySignShine, LLC will always act to make sure that delivery schedules are met. However, unexpected equipment failure, malfunction, and/or technical problems may delay the manufacturing process. In no case shall MySignShine, LLC be liable for any consequential damages resulting from any delay in production, shipment, or delivery of Products. All MySignShine, LLC customers agree not to hold MySignShine, LLC liable for delays in shipments caused by weather conditions, shipping company delays, international customs issues or any other circumstances beyond MySignShine, LLC’s direct control. MySignShine, LLC does not act on behalf of the United Parcel Service (“UPS”). Shipment delivery times displayed on the Website are published UPS estimates; Ground (1 to 5 business days) and Standard (1 to 5 business days).

Limited Warranty

For a limited time of 30 calendar days after receiving the shipment, MySignShine, LLC will assume responsibility for any item that does not work properly by repairing it at no charge to the customer. If a purchased product is believed to be defective in any way, the customer agrees to contact MySignShine within 30 calendar days of receiving the product shipment. MySignShine Support Staff will troubleshoot the issue with the customer via telephone, email, or both. If it is determined that the issue is with the MySignShine product itself and not user error, MySignShine, LLC will instruct the customer to return the unit in question for repair at no charge to the customer. The customer agrees to return the unit in question for repair or this Limited Warranty becomes null and void. All sales are final. MySignShine, LLC will not issue refunds under any circumstance.

Indemnification

You agree to defend, indemnify and hold harmless MySignShine, LLC and our partners, agents, officers, directors, employees, subcontractors, successors, assigns, third party suppliers of information, attorneys, advertisers, product and service providers, and affiliates (collectively, “Affiliated Parties”) harmless from any liability, loss, claim and expense, including reasonable attorney’s fees arising from or related to (a) your use of the Website, (b) your breach of the Terms of Use, (c) your dispute with another user, and (d) the unauthorized access to any protected area of the Website.

Limitation of Liability

MySignShine, LLC including its directors, officers, employees, agents, and any Affiliated Party shall not be liable for any damages including any special, direct, indirect, incidental, exemplary, or consequential damages, expenses, lost profits, lost savings, business interruption, lost business information, or any other damages arising out of, (a) the use or inability to use the Website, the Services, or any of the software even if MySignShine, LLC has been advised of the possibility of such damages, (b) the unavailability or interruption of the Website or any features thereof, (c) your use of the Website, (d) any delay or failure in performance beyond the control of MySignShine, LLC. THE AGGREGATE LIABILITY OF MYSIGNSHINE, LLC AND THE AFFILIATED PARTIES IN CONNECTION WITH ANY CLAIM ARISING OUT OF OR RELATING TO THE WEBSITE AND/OR THE PRODUCTS, INFORMATION, DOCUMENTS AND SERVICES PROVIDED HEREIN OR HEREBY SHALL NOT EXCEED $100 AND THAT AMOUNT SHALL BE IN LIEU OF ALL OTHER REMEDIES WHICH YOU MAY HAVE AGAINST US AND ANY AFFILIATED PARTY.
